Please read below in its entirety for a description of terms and conditions. (Note: words beginning with capital letters are defined in this text.)
Summary of Program Protections:
PROTECTION A: CANCEL FOR A “COVERED” REASON:
Apple Tours & Travel, Inc.'s ("Apple Tours") Payment Protection Program ("PPP") provides a total refund "value" of 100% of the Covered Trip costs that have been paid up to the date of cancellation (minus the PPP costs and any non-refundable airfare costs, if applicable*) when the traveler cancels his/her participation due to a covered Sickness or Injury involving the traveler which, at the time of cancellation results in medically imposed restrictions, as certified by a Physician is so disabling as to prevent the traveler from participating in the Covered Trip. *If, at the time of cancellation for a "Covered Reason", Apple Tours has purchased non-refundable airline tickets, the traveler may receive as part of their refund "value", airline vouchers, certificates, gift cards or credit, dependent upon the specific policies of the airline that was contracted for service on behalf of the group and traveler. Apple Tours will not be liable for any financial loss from airline policies regarding airfare purchased on behalf of the traveler. The Payment Protection program considers airline vouchers, certificates, gift cards and credits as "value" and as part of the total value refund calculation. To be effective, cancellation under Protection "A" must: a) be in writing with supporting medical documentation and received by Apple Tours at least 24 hours prior to the Covered Trip's Departure Time; and b) involve a Sickness, Injury that commences, or death that occurs, while the traveler's account is paid in full by the Final Payment Date (please note this includes both the trip cost and the Payment Protection Program cost). There is no eligible protection if the account is not paid in full.
To be effective, cancellation under Protection “A” must: a) be in writing with supporting medical documentation and received by Apple Tours at least 24 hours prior to the Covered Trip’s Departure Time; and b) involve a Sickness, Injury that commences, or death that occurs, while the traveler’s account is paid in full by the Final Payment Date (please note this includes both the trip cost and the Payment Protection Program cost). If cancellation is received by Apple Tours less than 24 hours prior to departure OR the traveler’s account is not paid in full by the Final Payment Date (Trip cost plus Payment Protection Program), the traveler is not eligible for any refund. There is no eligible protection if the account is not paid in full.
PROTECTION B: CANCEL FOR A “NON-COVERED” REASON:
If the traveler cancels the trip for a reason other than a Covered Reason within the cancellation guidelines, Apple Tours Payment Protection Program provides a total refund value of 75% of the Covered Trip costs that have been paid up to the date of cancellation (minus the Payment Protection Program costs and any applicable additional airline, hotel, activity, or other transportation fees) when the traveler cancels his/her participation in the trip.
To be effective, cancellation under Protection “B” must a) be in writing and received by Apple Tours at least 48 hours prior to the Covered Trip’s Departure Time; and b) the traveler’s account must be paid in full by the Final Payment Date (please note this includes both the trip cost and the Payment Protection Program cost). If cancellation is received by Apple Tours less than 48 hours prior to departure OR the traveler’s account is not paid in full by the Final Payment Date (Trip cost plus Payment Protection Program), the traveler is not eligible for any refund. There is no eligible protection if the account is not paid in full.
The following Special Exceptions apply to both Protections A & B, above:
Apple Tours (by itself or through the Payment Protection Program) will not provide any refunds in the event that Apple Tours cancels the Covered Trip as a result of, or following acts of force majeure, including, but not limited to, an act of God, war (whether declared or not), terrorism, civil unrest,pandemic, disease, sickness, unsafe sanitary conditions, quarantine or the unlikely event of Apple Tours & Travel’s bankruptcy, insolvency or cessation of business.
Definitions:
Accident means a sudden, unexpected, unintended and external event, which causes Injury.
Covered Trip means a scheduled trip for which the Trip Protection Program has been elected and the payment paid; the Covered Trip has defined departure and return dates specified upon enrollment.
Elective Treatment and Procedures means any medical treatment or surgical procedure that is not medically necessary including any service, treatment, or supplies that are deemed by the federal, or a state or local government authority, or by us to be research or experimental or that is not recognized as a generally accepted medical practice.
Immediate Family Member includes the traveler and the traveler’s, spouse, child, spouse’s child, son-daughter-in-law, parent(s), sibling(s), grandparent(s), grandchild, step brother-sister, step-parent(s), parent(s)- in-law, brother-sister-in-law, aunt, uncle, niece, nephew, guardian, Domestic Partner, foster-child, or ward. Domestic Partner means a person who is at least eighteen years of age and you can show: 1) evidence of financial interdependence, such as joint bank accounts or credit cards, jointly owned property, and mutual life insurance or pension beneficiary designations; 2) evidence of cohabitation for at least the previous 6 months; and 3) an affidavit of domestic partnership if recognized by the jurisdiction within which they reside.
Injury means bodily harm caused by an Accident which: 1) occurs after Apple Tours has received full payment for the Payment Protection Program from the traveler; and 2) requires examination and treatment by a Physician.
Physician means a person licensed as a medical doctor by the jurisdiction in which he/she is a resident to practice the healing arts. He/she must be practicing within the scope of his/her license for the service or treatment given and may not be you or an Immediate Family Member of yours.
Scheduled Departure Date means the date on which you are originally scheduled to leave on your Covered Trip.
Sickness means an illness or disease of the body which: 1) requires examination and treatment by a Physician, and 2) commences after Apple Tour’s has received full payment for the Payment Protection Program.
Covered Reason means a Sickness, Injury, or death involving the traveler or traveler’s Immediate Family Member, which necessitates medical treatment at the time of cancellation and results in medically imposed restrictions, as certified by a Physician, which prevents the traveler’s participation in the Covered Trip or causes a life threatening medical emergency or poses a threat of grave bodily harm to the traveler’s Immediate Family Member. Covered Reasons do not include:
1. being under the influence of drugs or intoxicants, unless prescribed by a Physician;
2. Elective Treatment and Procedures;
3. Suspension or expulsion from school; or
4. a loss that results from an illness, disease, or other condition, event or circumstance which occurs prior to Apple Tour’s receipt of full payment for the Payment Protection Program.
Cancellations should be reported as soon as possible to Apple Tours and Travel, Inc., by faxing the request for cancellation with any relevant supporting documents to Apple Tours to: (619) 299-9625 or by emailing the request and information to sales@apple-tours.com. Your request must include the traveler’s name, trip name, trip departure date, and details describing the nature of your cancellation with any supporting Physician’s notes.
